Terms of Service

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Senchabot ("we", "us", or "our"), concerning your access to and use of the Senchabot application and any related services (collectively, the "Services").

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Services. If you are using the Services on behalf of an organization or entity, you represent and warrant that you have the full power and authority to bind that organization to this Agreement.

2. Eligibility and Age Requirements

By using the Services, you represent and warrant that:

  • Minimum Age. You are at least 13 years of age, or such higher minimum age as may be required by the digital consent or data protection laws of your country of residence (for example, 14, 15, or 16 in certain European Economic Area member states). If you do not meet the applicable minimum age, you are strictly prohibited from using the Services.
  • Minors. If you are at least the applicable minimum age but under the age of 18 (or the age of legal majority in your jurisdiction), you may only use the Services with the express consent and under the active supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • No Age Data Collected. We do not ask for, collect, store, or process your date of birth, age, or any age-related personal data. We do not perform age verification of our own.
  • Reliance on Platform Policies. The Services operate on Discord, Twitch, Kick, and YouTube. Each of these platforms maintains its own age-gating and account creation policies. By creating an account on any of these platforms and using the Services, you confirm that you have already met that platform's minimum age requirements. We rely on the platform's enforcement of its own age policies; we do not independently verify your age.
  • Action on Violation. If we become aware or reasonably suspect that a user does not meet the applicable minimum age requirements, we reserve the right, at our sole discretion and without prior notice, to block or permanently ban that user's access to the Services.

3. Use of Services and Restrictions

Senchabot is provided to enhance your community management on platforms like Discord, Twitch, Kick, and YouTube. By using our Services, you agree that you will not:

  • Use the Services for any illegal or unauthorized purpose, or in violation of any local, state, national, or international law.
  • Violate the Terms of Service of the platforms on which Senchabot operates (e.g., Discord, Twitch, Kick).
  • Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
  • Attempt to gain unauthorized access to the Services or their related systems or networks.
  • Reproduce, duplicate, copy, sell, resell or exploit any portion of the Services without our express written permission.

4. Account Security, Overlay URLs, and Unauthorized Access

You are responsible for maintaining the confidentiality and security of your account, login credentials, connected third-party platform authorizations (such as Twitch, Kick, Discord, or YouTube OAuth permissions), and sensitive integration endpoints (including OBS browser source URLs and overlay tokens).

  • Responsibility for Account Activity. You accept full responsibility for all activities, triggers, bot commands, timers, settings, and content modifications executed under your account or through your unique overlay URLs and API tokens.
  • Compromised Credentials or Leaked URLs. If your account credentials, platform OAuth tokens, or OBS overlay URLs are compromised, disclosed, or broadcast publicly, you agree to immediately secure your account and regenerate the exposed URLs or tokens using the tools provided in the Senchabot dashboard.
  • Disclaimer for Third-Party Breaches and Hacks. Senchabot is not liable for any unauthorized access to your account, malicious modifications to your settings, unapproved bot commands, widget configurations, or overlay content, channel penalties, platform strikes, or suspensions (including strikes or bans issued by Twitch, Kick, YouTube, or Discord) resulting from compromised credentials, stolen tokens, malware, or unauthorized third-party intrusion.
  • Right to Mitigate and Suspend. If we detect unauthorized tampering, exploit attempts, or abusive or malicious content generated through your account or integration tokens, Senchabot reserves the right, at its sole discretion, to invalidate active tokens, reset configurations, purge offending content, or suspend access without prior notice.

5. Intellectual Property Rights

Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

6. User-Generated Content, Safe Harbor, and Notice-and-Takedown

Senchabot operates as an interactive computer service, hosting provider, and neutral intermediary. Users may create, configure, submit, or transmit custom chatbot commands, timer announcements, interactive widget items, overlay graphics, alert labels, and channel point configurations (collectively, "User-Generated Content" or "UGC"). You retain ownership of your UGC, but represent and warrant that your content does not violate any applicable law, third-party intellectual property rights, or platform community guidelines.

  • Safe Harbor and Intermediary Immunity. In accordance with Section 230 of the United States Communications Decency Act (47 U.S.C. § 230), the European Union Digital Services Act (Regulation (EU) 2022/2065), the E-Commerce Directive (Directive 2000/31/EC), and analogous international intermediary safe harbor frameworks, Senchabot is not the publisher, speaker, or author of any UGC provided by broadcasters, moderators, or viewers.
  • No Pre-Screening Obligation. Senchabot does not actively monitor, verify, or pre-screen all UGC transmitted or displayed through the Services. We expressly disclaim any liability for offensive, defamatory, unlawful, or infringing material created, customized, or broadcast by users.
  • Notice and Takedown Procedure. If you are a copyright owner, trademark holder, platform representative, or affected individual who believes that any content hosted on or transmitted through the Services infringes your rights, violates platform terms, or constitutes illegal material, please submit a formal notification to our designated contact at: [email protected] (or [email protected]). Your notice must include: (i) identification of the material claimed to be infringing or unlawful; (ii) the channel, URL, or specific location where the material appears; (iii) your full contact information; and (iv) a statement of good-faith belief that the use is unauthorized. Upon receipt of a valid notice, Senchabot will act expeditiously to investigate and remove or disable access to the offending content.
  • Repeat Infringers and Account Termination. Senchabot enforces a strict repeat infringer policy. We reserve the right, at our sole discretion, to permanently terminate or suspend access to the Services for any user who repeatedly infringes intellectual property rights or violates applicable laws and community guidelines.

7. User Data and Privacy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

8. Billing, Cancellation, and Refunds

Paid subscription billing, cancellation behaviors, and refund handling are explicitly described in our Billing Policy and Refund Policy. You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us (or our payment processors, such as Polar) to charge your chosen payment provider.

9. Interactive Features, Randomizers, and Gamification Tools

Senchabot provides interactive community features, including but not limited to "Spin the Wheel" (Wheel of Fortune), channel point redemptions, giveaways, and chat-triggered randomizers (collectively, "Interactive Features"). By enabling, configuring, or utilizing these features, you expressly agree to the following:

  • Entertainment Purpose Only. Interactive Features are provided strictly for community engagement and entertainment. You may not configure or use these tools to operate illegal gambling, lotteries, games of chance for monetary value, raffles requiring financial consideration, or any mechanism that violates local, state, national, or international gambling regulations.
  • Compliance with Platform Policies. All custom rewards, interactive widget items, and redemptions must strictly adhere to the Terms of Service and Community Guidelines of the host platform (including the Twitch Channel Points Acceptable Use Policy and Kick Community Guidelines). You are strictly prohibited from configuring interactive items or custom labels that involve or promote hate speech, harassment, self-harm, dangerous stunts, illicit substances, or sexually explicit content.
  • Streamer Responsibility & Prize Fulfillment. You acknowledge that Senchabot is solely a software tool and neutral randomizer. Senchabot is not a sponsor, organizer, or party to any agreements, challenges, or prizes established between broadcasters and their viewers. The streamer is solely responsible for fulfilling any promised rewards or adhering to custom rules. Senchabot bears no liability for unfulfilled prizes, streamer conduct, or viewer disputes.
  • Server Authority & Technical Discrepancies. Randomized outcomes are computed, validated, and logged server-side. In the event of network latency, browser rendering lag, OBS overlay desynchronization, or client-side visual glitches, the server-side log in Senchabot's database represents the final, authoritative result. Senchabot is not liable for lost channel points, failed triggers, or API disruptions caused by third-party platform downtime or token expirations.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE SERVICES, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the Services or breach of these Terms.

13. Modifications to the Services and Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms. Your continued use of the Services after such updates will constitute your acceptance of the revised Terms.
