Terms of Service

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Senchabot ("we", "us", or "our"), concerning your access to and use of the Senchabot application and any related services (collectively, the "Services").

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Services. If you are using the Services on behalf of an organization or entity, you represent and warrant that you have the full power and authority to bind that organization to this Agreement.

2. Eligibility and Age Requirements

By using the Services, you represent and warrant that:

  • Minimum Age. You are at least 13 years of age, or such higher minimum age as may be required by the digital consent or data protection laws of your country of residence (for example, 14, 15, or 16 in certain European Economic Area member states). If you do not meet the applicable minimum age, you are strictly prohibited from using the Services.
  • Minors. If you are at least the applicable minimum age but under the age of 18 (or the age of legal majority in your jurisdiction), you may only use the Services with the express consent and under the active supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • No Age Data Collected. We do not ask for, collect, store, or process your date of birth, age, or any age-related personal data. We do not perform age verification of our own.
  • Reliance on Platform Policies. The Services operate on Discord, Twitch, and Kick. Each of these platforms maintains its own age-gating and account creation policies. By creating an account on any of these platforms and using the Services, you confirm that you have already met that platform's minimum age requirements. We rely on the platform's enforcement of its own age policies; we do not independently verify your age.
  • Action on Violation. If we become aware or reasonably suspect that a user does not meet the applicable minimum age requirements, we reserve the right, at our sole discretion and without prior notice, to block or permanently ban that user's access to the Services.

3. Use of Services and Restrictions

Senchabot is provided to enhance your community management on platforms like Discord, Twitch, and Kick. By using our Services, you agree that you will not:

  • Use the Services for any illegal or unauthorized purpose, or in violation of any local, state, national, or international law.
  • Violate the Terms of Service of the platforms on which Senchabot operates (e.g., Discord, Twitch, Kick).
  • Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
  • Attempt to gain unauthorized access to the Services or their related systems or networks.
  • Reproduce, duplicate, copy, sell, resell or exploit any portion of the Services without our express written permission.

4. Intellectual Property Rights

Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

5. User Data and Privacy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

6. Billing, Cancellation, and Refunds

Paid subscription billing, cancellation behaviors, and refund handling are explicitly described in our Billing Policy and Refund Policy. You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us (or our payment processors, such as Polar) to charge your chosen payment provider.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE SERVICES, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the Services or breach of these Terms.

10. Modifications to the Services and Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms. Your continued use of the Services after such updates will constitute your acceptance of the revised Terms.
